He is survived by one son, Addison Ross, of Meyers Crossing, a brother, Jacob Ross, of Belvidere, N.J. and five grandchildren and six great-grandchildren.
Funeral services will be held at the Johnsonville church on Friday at 2 pm in charge of Rev. George Bear and interment will be made in the North Bangor Cemetery.

Funeral Thursday at 2 p.m. from his late home, followed by services in St. Paul's Lutheran Church, North Bangor, and interment in the adjoining cemetery.

He was also a member of the Loyal Order of Moose, of Bangor and the Knights of the Golden Eagle, of Easton.

Besides the son at whose home he died, he is survived by four grand-children and by two step-sons, William DeCue, of Columbia, N.J. and Aaron DeCue, of Petersburg, Va.

The funeral will be held Wednesday at 2 p.m. from the Labar home with the Rev. J. Frederick Stolte, PhD of Bangor officiating. Interment will be made in the family plot in the North Bangor cemetery.

I give unto Mary Rone my daughter all my housel furniture, beds and beding.

I do order that my grandson Robert Scott shall hav an equal share with the other heirs wen he arivs at the age of twenty one years, to be paid to him by me Executors hereinafter mentioned.

I do give to Lewis Ross my Compis and Saff.

On the 11th day of January in the year of our Lord 1798 Before me the subscriber personally came John Johnson and James McElheeny Junr., two of the subscribing witnesses to the foregoing Last Will and Testament of Thomas Ross, deceased, who being duly sworn according to law did respectively depose and say that they were present and did see and hear Thomas Ross, the said Testator, sign, seal, publish and declare the same as and for his Last Will and Testament and that at the dong thereof he, the said Testator, was of sound mind, memory and understanding, to the best of their knowledge and Belief, and also that they these deponants, together with Samuel Rothrock and William Loder, subscribed their respective names as witnesses tot he same in the presence and at the request of the said Testator and in the presence of each other.

"David, son of Thomas and Janes Ross, was married and settled in Upper Mount Bethel Township, Northampton County, Pa. He served as a private in Captain Hugh Gaston's Company of the Fifth Battalion of Northampton Co., Pa., Militia in the War of the American Revolution. His will, made in Upper Mount Bethel Township, and probated at Easton, Pa., Feb 16, 1811, refers to his wife, not named, as living, and names his brothers, James, Thomas, Zachariah and John, and his sisters, Elizabeth and Mary, married to David Moore. He also named Thomas Ross of New Hope, Bucks Co., Pa. No reference to any children of David Ross."

I have found no Ross's listed in the Upper Mount Bethel censuses through 1840. However, his will states that he is of Upper Mount Bethel.1

Therefore I think it likely that this David refers to the son of Thomas Ross and Jane Labar. But no active duty is indicated during the time that Capt. Gaston led the company.

On the 11th day of September AD 1832 personally appeared in Open Court of Common Pleas now sitting in and for the County of Northampton, Thomas Ross, a Resident of Lower Mount Bethel in the said County _____, aged about seventy years, who being first duly sworn according to Law, doth on his Oath make the following Declaration in order to obtain the benefit of the Act of Congress passed the 7th day of June 1932. That he entered the service of the United States under the following named Officers, and served as herein stated.

He volunteered in the Year 1776, the first part of it. That he went from the place of his residence in Lower Mount Bethel Township in said County under Captain Timothy Jane of the same County and marched to Amboy from thence to the City of New York, and from thence to Long Island where he was under the same Captain, Lieutenant Peter Midoch, and Colonel Kechline and General Sterling.

The next day after his arrival on the Island the American and British Forces had an engagement in which the Americans were defeated and retreated to New York. A great part of the company in which he was, were killed and his Captain and Colonel taken prisoners. From New York they were ordered by Putnam to Dulencies Mills [DeLancey's Mills, South Bronx] to join Col. Hand and stayed with him about two months or more. Then ordered to Amboy to join the Bucks County five months men. Then ordered, after some time, to Fort Lee. Thence he was ordered to Fort Washington commanded by Col. McGaw. He continued under Col. McGaw's command for some weeks until the Engagement at that fort. The American forces were defeated and himself and the great part of the Army taken prisoners and taken to New York and there confined in a church. After some weeks' confirement he was taken on board a Ship and conveyed up the East River near a place called Hurl Gate [Hell Gate] from thence taken on board of Boats to South Amboy and his name taken for an exchange and released. From there he came home, after an absence of more than six months. He remained at home 4 or 5 years and was then ordered out to fight the Indians up the Delaware in the 7th Class. He went up the River to a fort called Vanauken's fort and was there under command of Capt. Dewitt about 2 months when he was discharged. [This fort was at Port Jervis.]

He had no documentary evidence and knows no person whose testimony he can procure, to testify to his service. He hereby relinquishes every claim whatever to a pension or an annuity except the present, and declares that his name is not in the Pension Roll of any Agency of any State or (if any) only in that of the Agency of the States of New York or New Jersey.

Sworn and subscribed the day and year aforesaid in Open Court. Thomas Ross, his mark.

We, John Augustus Probts, a clergyman, residing in the Borough of Easton, County of Northampton, and Commonweath of Pennsylvania, and George Vanness of the Same County and Commonwealth, hereby certify, that we are well acquainted Thomas Ross, who has subscribed and sworn to the above Declaration, that we believe him to be about 75 years of age, that he is reputed and believed, in the neighborhood where he resides, to have been a soldier of the Revolution, and that we concur in that opinion.

And the Said Court do hereby declare their opinion, after the investigation of the matter, and after putting the Interrogatories prescribed by the War Department, that the within named applicant was a Revolutionary Soldier and Served as he within states.

And the Court further Certify, that it appears to them that John Augustus Probts who has signed the Preceding Certificate, is a Clergyman, residing in the Borough of Easton, County of Northampton and Commonwealth, and that George Vanness who has also signed the same, is a resident in the neighborhood of the said Thomas Ross, and is a creditable Person, and their statement is entitled to credit.

[spelling as in the records] After the introductory paragraph, Thomas states that after his debts be paid,
"all the residue of my Goods, Chattels and Household furniture (Excepting what household furniture my loveing wife Easter may or shall require for the use of hersef and the accommodation of my son James who is to live with her during her life) shall be appraised, and after such appraisement made, that my executors shall expose the same to sale as soon after my decease as conveniently it can be done.

And the proceeds ariseing from said sale to be equally divided into nine equal parts or shares for the use of my children and legal representatives agreeable to a clause in this my will which will be particularly inserted hereafter, by which my Executors as shall be hereafter named are to be directed and guided for the distribution of both my personal as also my real estate share and share alike.

And I do further order and direct that my wife is to have her choise of any two milch cows that she may choose out of my stock of cattle, two hogs and six sheep, previous to an appraisement, and also what articles of kitchen and household furniture my wife shall require for the use & accommodation of herself and her son James (who is to live with her during his life).

And after her decease, what Articles of stock, Kitchen & Household furniture shall be left, I direct my Executors to make public sale of the same and that the proceeds of said sale it is to be equally divided amount my children and representative as aforesaid.

And it is my Will and I order and direct that the farm on which I at present reside, be not sold during the life of my Wife who is to live in the house if she sees proper so to do and I do direct my Executors to rent the said farm and the rents to be applied for the use and support of my wife and son James as long as she may live, but after her decease I direct my executors to make sale of the said farm to the best advantage posable.

And after such sale I do direct my Executors to take a Bond from the purchase for the sum of One thousand Dollars out of the first payments which sum is to remain in the hands of the purchaser during the life of my son James, and the Interest of said sum to be paid yearly or half yearly as his case may require for his support, and the principal to be secured by Mortgage on the premises. And it is my further Will that the said Bond that is given to my Executors for the sum of One thousand Dollars, is to be lodged in the hands of Peter Miller, son of Frederick Miller, dec'd, who is to collect the Interest as aforesaid and apply it for the Maintenance and clothing of my son James during his life, and after his death the said Bond is to be given up by sd. Peter Miller to my Executors, they allowing a reasonable charge to the said Peter for his trouble, and the principal to be collected by my Executors and to be equally divided among my children or their legal representatives my Executors having due regard to the clause hereafter inserted and previously noticed which will have reference to three of my children - namely - John, Mary and Jane.

Thirdly, as touching the residue and remainder of my real Estate, I allow and direct my Executors to make sale of the same as soon as circumstances will permit them so to do after the decease of my wife, and the proceeds arising from said sale to be equally divided amongst my children and representatives share and share alike.

Fourthly that is to say, the remainder and residue of my Estate I do hereby order and direct shall be divided into eight equal shares or parts. And I do hereby give and bequeath unto each of my five children, Robert, Samuel, David, Elizabeth and Thomas, their heirs and assigns one equal shre thereof, that is to say, to each of them the one equal eighth part of the residue of my estate as aforesaid.

Fifth, I give and bequeath the one equal eighth part of the said residue of my Estate unto Joseph Ross of Lower Mt. Bethel township aforesaid, his heirs executors or administrators, in trust nevertheless that he the said Joseph Ross shall and will as soon as he conveniently can after receiving the said legacy invest the same on good security at Interest payable at least half yearly and from time to time receive and take the interest thereon, as it shall become due and shall and will pay the same over half yearly to my son John Ross for and during the term of his natural life for his comfortable maintenance and support, and if the said interest money shall not be sufficient in the opinion of the said Joseph Ross for that purpose, then in the further trust that he, the said Joseph Ross, shall from time to time as the same shall be necessary, pay to my said John Ross so much of the principal of the said legacy as shall be necessary and for the comfortable maintenance and support of my said son John as aforesaid. At and after the decease of my said son John Ross, in trust that he the said Joseph Ross, his executors or administrators, shall and will pay over the said legacy or so much thereof (if anything) as shall be left after providing for the support of my said son John as aforesaid, to the children and legal representative of my said son John share and share alike.

Sixth, I give and bequeath to my daughter Mary, who is intermarried with Adam Steel, the one equal eighth part of the residue of my Estate intire and exclusive of her husband for her own sole and separate use, And for which legacy and bequeath her receipt only and none other will be a sufficient discharge. And further, if it should so happen that my daughter Mary should die previous to her receiving her full share of my Estate, in that case, it is then to be equally divided amongst her children or the survivors of them, share and share alike.

Seventh, I give and bequeath one equal eighth part of said residue of my estate unto Robert Simanton of Lower Mt. Bethel township aforesaid, his Executors or administrators in trust. Nevertheless, that he the said Robert Simanton shall and will, as soon as he conveniently can, after receiving the said legacy, invest the same on good security at interest payable half yearly & from time to time receive and take the interest thereon as it shall become due, and shall and will pay the same over half yearly to my daughter Jane (who is intermarried with William Galloway) for and during the term of her natural life for her comfortable maintenance and support. But if the said interest money shall not be sufficient in the opinion of the said Robert Simanton, for the purpose, then in the further trust that he the said Robert Simanton, shall from time to time as the same shall be necessary, pay to my daughter Jane so much of the principal of the said lagacy and as shall be necessary for the comfortable maintenance and support of my said daughter Jane as aforesaid. And at and after the decease of said daughter Jane in trust, that he the said Robert Simanton, his Executors or Administrators, shall and will pay over the sd. legacy or so much thereof (if anything) as shall be left after providing for the support of my said daughter as aforesaid, to the children and legal representatives of my said daughter, share and share alike.

Seventh [sic], I do hereby nominate and appoint Conrad Young and James Simanton both of Lower Mt. Bethel township...to be executors...

And lastly my express Will and meaning is, and I do order and direct, that if any difference, dispute, question or controversy shall be moved, arise, or happen concerning any gift, bequest, or other matter or thing in this my will given or bequeathed , expressed or contained, that then, no suite or suites in law or equity or otherwise shall be brought, commenced or prosecuted for and concerning the same, but the same shall be referred wholly to the award order and determination of loving friends Robert Simanton and Christian Cressman, both of Lower Mt. Bethel aforesaid, and what they shall order, direct or determine therein shall be binding and conclusive to and on all and every persons therein concerned.

The deceased took an active part in the American struggle for Independence, was taken prisoner at Fort Washington, endured the hardships of a Prison ship amidst appalling hunger and death. He continued through life a firm advocate of the Constitution and his country's rights, was laid with his Fathers in peace, at an advanced age, attended by a large assemblage of people.

Before me John DeYoung, one of the Justices of the Peace, in and for the County of Northampton, personally appeared Eloner McCracken, of the Township of Upper Mount Bethel, in said County, who being duly sworn according to law, doth depose and say that she is about seventy-eight year of Age, and is of Sound mind, memory and understanding, that she was well acquainted with Thomas Ross and his Wife Ester, late of Lower Mount Bethel Township in said County deceased, that the parents of said Ester Ross, dec'd, formerly Ester Simonton, used to live also in said Township of Lower Mt Bethel, and she, the said Eloner McCracken, lived with them before said Ester was married to said Thomas Ross deceased; that said Thomas Ross got married to said Ester Ross dec'd (formerly Ester Simonton) when the said Eloner McCracken was six years old, namely about seventy two years ago, which would be in the Year Anno Domini 1779, they were married by the Rev'd Mr. Tweed, in the Dwelling of Robert Simonton, dec'd, in said Township of Lower Mount Bethel, father of said Ester Ross, dec'd, that the said Elenor was present at the Wedding. And farther saith not.

On this nineteenth day of October in the year of Our Lord one thousand eight hundred and fifty two, personally appeared before the Court of Common Pleas of the County of Northampton aforesaid, Samuel Ross, a resident of the Township of Lower Mount Bethel in the said county of Northampton, aged sixty-six years and upwards, who being first duly sworn according to law, doth on his oath, make the following declaration in order to obtain the benefits of the Provision made by the Act of Congress passed July 7, 1838 entitled "An act granting half pay and pensions to certain widows" and the acts in addition thereto.

That Esther Ross the mother of this declarant, was the widow of Thomas Ross senior, who was a private in the company commanded by Captain Timothy Jayne in the war of the Revolution; that he volunteered at Easton in the county of Northampton aforesaid, in the year 1776; that he marched under the command of the aforesaid Captain Jayne to Amboy, thence to New York, and thence to Long Island; that the regiment to which he then belonged was commanded by Colonel Reckline and was part of the division commanded by General Sterling; that he then marched under the orders of General Putnam to Dulinias Mills to join Colonel Hand, and was there in active service for two months; that he was ordered thence to Amboy to join the Bucks County five month's men; that he was then ordered, after some time, to Fort Lee, and then to Fort Washington commanded by Colonel McGaw; that he continued under the command of Colonel McGaw until he was subsequently taken prisoner, and remained in such captivity for some time, until he was finally exchanged; that the whole period of his services performed n the manner and at the time above mentioned, and was eight months and fourteen days, as in and by the muster rolls of the said companies respectively and other the records of the War Department; relation thereunto being had, more fully and at large appears. That this declarent has no documentary evidence of the services of his father aforesaid.

He further declares that his said Mother, the aforesaid Esther Ross, was married to the said Thomas Ross in or about the year one thousand seven hundred and seventy seven or seventy eight; that the said Esther Ross was not married to him prior to his leaving the service but the marriage took place previous to the first day of January, seventeen hundred and ninety four, namely at the time above stated.

He further declares that his father, Thomas Ross senior, aforesaid, departed this life on the fourth day of March in the year of Our Lord one thousand eight hundred and thirty five in the Township of Lower Mount Bethel aforesaid; and that his mother, the aforesaid Esther Ross, also departed this life on the twenty-third day of June in the year of Our Lord one thousand eight hundred and thirty-nine at the Township aforesaid, leaving the following children living at her decease to wit: John Ross, Robert Ross, Mary then the wife, now the widow of Adam Steel, Samuel Ross, this declarent, Jane the widow of William Galloway, David Ross, Elizabeth widow of John Galloway, James Ross and Thomas Ross, junior, of who John Ross is since deceased, leaving a widow and issue, the other children and heirs above named being yet living.
