Maxwell Farmer is Dead: Funeral services will be held at 10 AM Monday in McNary Memorial Chapel for Charles Powell, 81, long time resident of Colusa County, who died early this morning in his Maxwell home. Mr. Powell was born in Glenn County on April 15, 1884. He had lived in Colusa County for the past 67 years and had engaged in farming. Survivors include his children, Mrs. Velda Lee and Mrs. Irene Link of Maxwell, Mrs. Aileen Hamilton of Orland, Edgar Powell of San Jose, and Lloyd Powell of Maxwell, a sister Mrs. Carl Plaskett of Willows, 11 grandchildren and 23 great grandchildren. Powell, 42, was released from Yuba County jail yesterday, 14 hours after she shot her husband, Carl Powell, 44, to death in what Sheriff John Dower termed a clear case of self defense. Dist. Atty. Joseph Heenan said today, "The facts are clear. It was a clear case of self defense, the defense of herself and her daughter from a drunken husband." No criminal charges will be brought against Mrs. Powell, Heenan said. Monday night, at the family home at 717 Cottonwood Ave., Linda, Mrs. Powell shot her husband twice at close range with a .300 caliber Remington automatic rifle after Powell had loaded the gun and threatened to kill her. The powell's 18-year-old daughter, Carroll, witnessed the shooting. Another daughter, Kay, 13, had run next door to call police, and an infant daughter, Deborah, lay in her crib in the next room when the shooting occurred. Mrs. Powell and Carroll had wrstled the deer rifle away from Powell and he was first shot as he continued to grapple on the floor with Carroll. He staggered to his feet and started toward his wife when she shot him a second time. Authorities said the fatal family argument ended a long series of similar battles in which Powell would get drunk and accuse his wife of infidelity. Powell's violent behavior during these arguments had resulted in police intervention on several occasions during the past three years. Funeral services for Powell will be conducted at 10 am Friday at McNary-Moore Chapel in Colusa. Powell's other survivors include his parents, Mr. and Mrs. Charles Powell of Maxwell, three sisters, Mrs. Eileen Hamilton of Elk Creek, Mrs. Irene Link of San Bernardino, and Mrs. Velda Lee of Maxwell, two brothers, Lloyd of Maxwell, and Edgar of Watsonville, and numerous nieces and nephews. Burial will be in Maxwell Cemetery. |
