Now know ye, that I the said Zachariah Ross do hereby confess and acknowledge that I have had and received of and from the said David Ross and james Ross the Legacy or Sum of one hundred and Seventy-eight Pounds, Eighteen shillings and eleven pence, being the Amount of the Sale of the one-seventh part of the Lands and Tenements, Goods and Chattels, Rights and Credits so as aforesaid given and bequeathed unto me by the said Thomas Ross. And therefore I do, by these presents, acquit, release and discharge the said David Ross and James Ross of and from all Legacies, Duties, Dues and Demands whatsoever which I, my executors or administrators, may have, claim, challenge or demand of or against the said David Ross & Jamess Ross, their Executors or Administrators by Virtue of the said Last Will and Testament of or out of the Estate of the said Thos. Ross, Deceased, as aforesaid.

Newspaper Mention11 September 1907The 11 September 1907 edition of the Danville Morning News, Danville, Montour County, Pennsylvania, reported "Old Cemetery is Passing

Wolf Monument will be Removed to Odd Fellows' Cemetery

The old cemetery on Bloom street is passing. Only half a dozen tombstones remain erect, a mere suggestion of the familiar old burial ground in which the first settlers were buried and which for over a hundred years occupied the well-known site. The work of grading is already under way and in a few days, the last trace of the famous old landmark will be effaced.

The old cemetery being oblitered, the tract must henceforth be known as the "park." The tract is driven full of stakes, on which by means of stout cords is indicated the grade.....[paragraph on the process of the grading]....

Yesterday the remains of John Lunger and wife, Anna, were being removed by Samuel Lunder, a son. The bodies of George and Sarah Lunder, were also being exhumed by Charles, William and Harry Lunger, sons of the couple. Other members of the Lunger family will also be removed. All will be taken to the Odd Fellows' cemetery.

The monument in the northeast corner erected tot he memory of the Wolf family will be removed to the Odd Fellows' cemetery along with the remains of Hiram Wolf, David Wolf, Josiah Wolf and Leah, wife of Samuel Wolf. Hiram Wolf was First Lieutenant in Company H, Second Pennsylvania volunteers, Mexican War. He was born July 9, 1823 and died March 5, 1866.

The two granite tombstones near the center, marking the graves of Zachariah and Jane Ross, will be removed to Bloomsburg. The date of birth on the oldest of these is 1761; of the death 1816. Jane Ross died in 1820 aged 94 years. Two tombstones belonging to the Gulick family will also be removed."

[Note: if these dates are correct, it is unlikely that Jane was Zachariah's wife, because dying at age 94, in 1820, she would have been born in 1726.]

Before me John DeYoung, one of the Justices of the Peace, in and for the County of Northampton, personally appeared Eloner McCracken, of the Township of Upper Mount Bethel, in said County, who being duly sworn according to law, doth depose and say that she is about seventy-eight year of Age, and is of Sound mind, memory and understanding, that she was well acquainted with Thomas Ross and his Wife Ester, late of Lower Mount Bethel Township in said County deceased, that the parents of said Ester Ross, dec'd, formerly Ester Simonton, used to live also in said Township of Lower Mt Bethel, and she, the said Eloner McCracken, lived with them before said Ester was married to said Thomas Ross deceased; that said Thomas Ross got married to said Ester Ross dec'd (formerly Ester Simonton) when the said Eloner McCracken was six years old, namely about seventy two years ago, which would be in the Year Anno Domini 1779, they were married by the Rev'd Mr. Tweed, in the Dwelling of Robert Simonton, dec'd, in said Township of Lower Mount Bethel, father of said Ester Ross, dec'd, that the said Elenor was present at the Wedding. And farther saith not.

Deed dated 28 April 1812, between John Boyd of Lower Mount Bethel, Taylor, and his wife Margaret, and John Ross, Taylor. John Ross paid John and Margaret Boyd $925, for a piece of land "situate in the Town called Richmond" in Lower Mount Bethel. It was located "in the great Road", bordering land of Christian Baker, Joseph Fulmer, William West and Isaac Myers dec'd, containing "3 acres and 81 perches strict measure." This is the same piece of land purchased by John Boyd from Arnold Bitters and Mary his wife on 24 January 1799, containing 83 perches, and another lot purchased from Ulrich Huntsbury and Elizabeth his wife, 30 May 1807, of two acres and 158 perches.

Deed 12 Oct 1813 between Moses Everitt, yeoman of Upper Mount Bethel, and John Ross, Taylor, of Lower Mount Bethel. John Ross purchased from Everitt, for the sum of $172.50, a piece of ground in the Village of Richmond, in the Township of Lower Mount Bethel.

Beginning at the southeast corner of a stable belonging to the heirs of Isaac Miers deceased, and also corner to a lot of ground belonging to George Slough, then along Slough's line, then along land of John Ross, then to the Highway, joining to the land of the heirs of Christian Baker, deceased. containing 68 3/4 perches. This was "the one half of the same lot of ground which Simeon Hart and his wife Elizabeth by Indenture" on 26 March 1810 sold to David Shannon. David Shannon and his wife Mary sold it to Moses Everitt on 21 March 1812. Witnesses William Everitt, I. Bowman.

It being the same three pieces of Land the one of which containing one hundred and two Acres, which Henry Stoufer and Elisabeth his Wfie by Indenture 3rd April A.D. 1810 and Recorded in the Recording Office for the County of Northampton in Book F, vol. 3, page 177, granted and conveyed unto William McQuown, the 2nd piece containing 12 acres and seven perches which Jacob Stoufer and Catherine his wife by Deed dated first March 1811 and Recorded in the Office aforesaid in Book G, Vol. 3, page 71, granted and conveyed unto William McQuown, the third piece containing 37 acres and 54 perches and allowance of 6 pct granted to the said William McQuown and the said William McQuown and Sarah his Wife by Deed dated 9th February 1813, granted and conveyed unto William Lander and Robert Miller as tenants in common, and the said Robert Miller and Jane his Wife by Deed dated 16 April 1818 granted his part to the aforesaid John Ross.

"I give and bequeath unto my dear wife, Maria Ross, three beds and bedding, one stove and pipe, burow, a large and small brass kettle, and a double leaf table. And I do further order, that all my other personal estate, shall be sold at public vendue, and also my real Estate, shal be sold at public vendue, as soon as it shall deem expedient to my hereinafter named Executor, and all the proceeds accruing from the said sales of my personal and real Estate, and all other Moneys due me by any person, shall be divided in manner following, that is to say, One third of the whole amount I give unto my above stated wife, Maria Ross, and the two remaining thirds, I request shall be equally divided among my three children, that is to say, One thinrd of the said two remaining thirds I give unto my son Loury [or Lowry] Ross. One other third unto my daughter Nancy intermarried to James McCray, and the last third as aforestated, I give unto my daughter Averline, intermarried to Solomon Reasley. And I do hereby constitute and appoint my friend John DeYoung Esq. of Lower Mount Bethel Township, county and state aforesaid, Executor of this my Last Will...In witness whereof I the Testator John Ross, have to this my Last Will and Testament, set my hand and seal, the sixteenth day of October A.D. 1841.

And in case it becomes necessary to borrow money to pay any of my debts due or owing by me at the time of my decease, I hereby direct and empower my Executors hereinafter named to create a lien either by Judgment or Mortgage in as full and ample a manner as I could if living. And as and immediately after the death of my wife, I direct that all my property be disposed of by my Executors or the survivor of them, both real and personal, they or the survivor of them having full power to sell, convey and make title for the same as I could if living and signed the Deed or Deeds myself. And the proceeds thereof I direct that it be equally divied share and share alike between my three children viz: Lewis L. Ross, Asa Ross and Agnes, and in case of the death of any one or more of my children before the death of my said wife and not leaving any isue or children then in that event their share be equally divided among my other children but in case of a deceased child leaving children or heirs at law that they receive the sahre that my deceased child would have been entitled to if living.
IV: And lastly and for the purposes hereinbefore mentioned I do nominate constitute and appoint my two sons Lewis L. and Asa Ross, Executor of this my last will and testament...
